USPAP Ethics & Unbiased Independence Rules

The Uniform Standards of Professional Appraisal Practice require that an appraiser's opinion be developed independently and impartially. We do not accept engagements in which loan amount, desired tax outcome, or advocacy posture is allowed to precondition the value conclusion. Engagement letters define intended use, intended users, property interest, effective date, and scope of work before inspection. Compensation is never contingent on a predetermined value, a loan closing, or a litigated outcome.

Ethics Rule obligations include confidentiality, record keeping, and avoidance of misleading communications. Marketing copy on this site is not an appraisal; every assignment begins with a written engagement and ends with a signed certification. When a client requests "support" for a target number, we decline or redefine the assignment as consulting only when USPAP permits—and never mislabel advocacy as an appraisal.

Appraisal independence in lending contexts

FIRREA and federal appraisal independence rules further restrict coercion by loan production staff. Independence test: if the value conclusion would change because a stakeholder prefers a different number, the assignment is compromised. We do not proceed on compromised assignments.

Retrospective (Date-of-Death) Comp Selection Rules

Date-of-death and other retrospective valuations require that market evidence reflect what was knowable as of the effective date. Sales that closed after the effective date may be considered only with careful temporal analysis and narrative justification; listing activity after the date is generally weaker evidence. Comparable selection prioritizes proximity in time, location, physical characteristics, and property rights—then applies paired-sales adjustments that can be explained to a probate judge or IRS examiner.

We extract MLS history, public records, and verified closed-escrow data, and we document why rejected sales were excluded. Thin luxury markets receive expanded search radii and scarcity discussion rather than forced use of dissimilar comps. Fractional interest and minority discount work, when required, relies on market evidence of control and marketability—not arbitrary percentages.

ANSI Z765 Square Footage Measurement Standard Compliance

Gross living area disputes destroy credibility faster than almost any other technical error. Our field protocol follows ANSI Z765 for residential measurement: exterior wall measurements where applicable, clear treatment of below-grade areas, and consistent inclusion/exclusion rules for garages, porches, and unfinished spaces. Laser distance measurement is standard; sketches are retained in the workfile with photographic corroboration of atypical conditions.

When prior surveys, architectural plans, or assessor records conflict with field measurement, the report discloses the conflict and states which figure is relied upon for valuation—and why. Commercial and special-use properties may require different measurement conventions; those conventions are stated explicitly so intended users are never left guessing which standard applied.

Courtroom Admissibility & Daubert Standard Defense

Litigation appraisals must be prepared as if a Daubert or Frye challenge is inevitable. Methodology is selected because it is reliable for the property type and market—not because it is convenient. Adjustment grids show the path from raw sale price to indicated value. Income approaches disclose rent sources, vacancy, expense ratios, and capitalization-rate support. Cost approaches show cost-source indices, depreciation logic, and land residual thinking where relevant.

Expert witness readiness includes deposition preparation, demonstrative exhibits drawn from the workfile, and a clear statement of assumptions and limiting conditions. Opposing experts are answered with data, not tone.
